Weston FL mayor Eric Hersh filed suit back in July charging that that the language on the proposed ballot was not clear in telling voter's that the new amendment would phase out "Save Our Homes" and ultimately end the 3% cap homesteaders enjoy.

Circuit Judge Charles Francis called the language on the ballot "misleading and confusing". . He also stated "Try as this court has, and having considered all memoranda and argument presented to the court, and having read, reread, examined and studied the ballot summary under review, this court cannot find that the language is clear, concise, unambiguous and fair."

Recent polls show that voter's agree, with only 47% for the amendment, well below the 60% needed to pass.

The ruling can be appealed or lawmakers can address the issue again in a special session scheduled for next month to address the budget.
